Acceptable Use Policy

The Great West Hosting™ Acceptable Use Policy has been formulated with the following goals in mind:

Ensure security, reliability and integrity of Great West Hosting™’ systems and network, the systems and networks of Great West Hosting™’ customers and the networks and systems of others
Avoid situations that may cause Great West Hosting™ or It’s Customers to incur civil liability
Maintain the image and reputation of Great West Hosting™ as a responsible provider
Preserve the value of Internet resources as a conduit for free expression
Encourage the responsible use of net resources, discouraging practices which degrade the usability of network resources, and thus the value of Internet services
Preserve the privacy and security of individual users.

The Acceptable Use Policy below defines the actions, which Great West Hosting™ considers to be abusive, and thus, strictly prohibited. The examples named in this list are non-exclusive, and are provided solely for guidance to Great West Hosting™' customers. Please note that the actions listed below are also not permitted from other Internet Service Providers on behalf of, or to advertise, any service hosted by Great West Hosting, or connected via the Great West Hosting™ network.

Improper Use

The User shall not:

Seek, by any means whatsoever, information regarding the personal identification, or password of any other User of the Internet or any network to which the User may be permitted access
Obtain, or seek to obtain, access to, or interfere with, any programs, or data maintained, by Great West Hosting™, except as permitted by Great West Hosting™;
Obtain, or seek to obtain, access to, or interfere with, any programs, or data maintained, by Great West Hosting™, except as specifically permitted by the policies of the network, (which form part of these terms and conditions). Without limiting the generality of the forgoing, the User shall not access the Internet except in accordance with this Agreement
Obtain or seek to obtain access to any other User's programs or data except with the explicit authorization of the other User
Knowingly develop or use programs which adversely affect or impact other Users, the Internet, or any Network
Use, transmit, or store anything obscene, offensive, or defamatory
Utilize the Internet for any purpose which is contrary to the laws of any government having jurisdiction over Great West Hosting™ or the User
Engage in any other activity that Great West Hosting™ determine in its unfettered discretion to be Improper Use of the Internet.

The User agrees to indemnify Great West Hosting™, its directors, employees, sponsors and agents against any loss, damage, or liability (including legal costs on a full indemnity basis) which may be sustained or incurred as a consequence of the User's failure to comply with this agreement whether the failure is attributable to the User or to some other person using the User's account with or without permission of the User.
The Site may be used only for lawful purposes. You agree that you will not:

post, upload, reproduce, distribute or otherwise transmit unauthorized or unsolicited commercial e-mail, junk or bulk e-mail, chain letters or other "spam";
engage in threats, harassment, intimidation, stalking or abuse of others;
scan or probe another computer system;
obstruct or bypass computer identification procedures;
engage in unauthorized computer or network trespass;
export equipment, software or data outside of Canada or the United States in contravention of applicable export control legislation;
post, upload, reproduce, distribute or otherwise transmit information or materials where such activity gives rise to civil liability, or otherwise violate the rights or assist others to violate the rights of Great West Hosting™ or any third party; such violations include but are not limited to engaging in copyright infringement, trademark infringement and defamation;
post, upload, reproduce, distribute, or otherwise transmit information or materials where such activity constitutes a criminal offence, or otherwise engage in or assist others to engage in any criminal offence; such offences include, but are not limited to, communicating hatred, pyramid selling, unauthorized use of a computer, mischief in relation to data, fraud, obscenity and child pornography;
engage in or assist others to engage in any activity that otherwise violates established or accepted netiquette(network etiquette), violates applicable charters, FAQs, policies, rules or guidelines of Great West Hosting™ or other parties, disrupts or threatens the integrity, operation or security of the Great West Hosting™ network, or any computer or Internet system, elicits complaints from other Internet users, is contrary to any law or regulation or, in the sole judgment of Great West Hosting™, is otherwise objectionable;
use or register Great West Hosting™ trade-marks, trade names or logos, including without limitation any such trade-marks, logos or service marks displayed on any web site(s) operated by Great West Hosting™, without Great West Hosting™ express prior written permission;
share, resell, reproduce, copy, distribute, redistribute, or exploit for any commercial purposes, any portion of, use of or access to, the Great West Hosting™, except where expressly authorized by Great West Hosting™; or
allow any other person or entity to engage in any of the foregoing activities while using your Great West Hosting™ account.

Great West Hosting™ may without notice terminate any User's privileges for any breach of this agreement.
The User shall indemnify Great West Hosting™ against any claim by a third party for alleged infringement of any copyright or any other intellectual property rights which arises as a result of the storage or processing of any of the User's programs or data on or through the Internet.
The User's programs shall be and shall remain the property of the User. Notwithstanding, Great West Hosting™ may in its discretion make and keep backups and examine the User's programs, data, printed output, other media in connection with its investigation of malicious disruption of computer services and of breaches of this agreement either by the User or by any other person.
Great West Hosting™ makes all commercially reasonable efforts to protect the confidential and personal information of its Users, as according to the Privacy Policy.
